The long-running legal battle between former Cabinet Secretary Raphael Tuju and the East Africa Development Bank (EADB) has reached a dramatic conclusion.
Auctioneers have finally moved to evict Tuju from his famous Dari/Tamarind Brasserie property located on Ngong Road.
This follows a major ruling by the Commercial Court in Nairobi that cleared the way for the bank to take over and sell his prime properties.
The dispute centers on a massive debt of Sh1.9 billion. Justice Wayua Mong’are, in her recent ruling, gave the green light for EADB to transfer Tuju’s Karen properties to a new owner to recoup the money.
The judge stated that the fresh case filed by Tuju was an attempt to make the court re-decide issues that had already been settled by other courts in both Kenya and the United Kingdom.
For years, Tuju had fought to stop Knight Frank Valuers Limited and Garam Investment Auctioneers from taking over his assets.
He argued that the bank had not followed the correct procedures and that the valuation of his property was unfair.
However, the court upheld the bank’s position, noting that reopening the case would be illegal as the matter had already gone through the full legal process in multiple jurisdictions.
The eviction marks a significant fall for the prominent politician and businessman.
His Dari Restaurant, known for its lush gardens and high-end dining, has been at the heart of this multi-billion shilling property war.
The bank originally provided the loan to Tuju's company, Kueiru Limited, for a real estate project, but the project ran into financial trouble, leading to the massive arrears.
With the court's final blessing, the auctioneers are now free to complete the transfer of ownership.
